Flood overlays versus actual flood risk: reading the mapping like a planner

A property sitting outside a mapped flood overlay is not the same as a property that will not flood. That single distinction trips up more due diligence than almost anything else in the planning space, because the map that a buyer or planner pulls up rarely says what event it represents, what depth it implies, or how old the underlying study is. The overlay is a planning trigger. It is not a statement of physical risk, and treating it as one leads to both false comfort and unnecessary panic.

This is a closer look at what flood mapping in Queensland and New South Wales actually encodes, how the two states frame it differently, and where the gaps sit that a careful reader has to fill with judgement rather than colour.

The layers hiding inside a single flood overlay

Most people see one shaded polygon and read it as "flood zone, yes or no". Underneath that polygon there are usually several distinct pieces of information, and they answer different questions.

The design flood event (DFE). In both states, planning controls are typically pinned to a nominated event, most commonly the 1% Annual Exceedance Probability flood, once called the 1-in-100-year flood. The AEP framing matters: 1% AEP means a one percent chance in any given year, not once a century. Over a 30-year mortgage the cumulative probability of experiencing that event is well above a quarter. A property mapped only to the 1% AEP line still floods in rarer events.

Flood planning area versus flood extent. Councils often add freeboard, usually around 500mm, to the modelled DFE level to set a flood planning level, then map the area below that level as the flood planning area. So the overlay you see may already include a safety margin above the modelled water surface. That is deliberate, but it means the overlay edge is not the modelled waterline.

Hydraulic category. The more useful studies split the extent into floodway, flood storage and flood fringe. Floodway is the part that actually conveys the flow and where filling or building is most tightly controlled. Flood fringe is shallower, slower storage where controls are lighter. Two lots inside the same overlay can face completely different development constraints depending on which category they fall in. If the mapping you are working from does not distinguish these, you are missing the information that most affects what you can build.

The PMF. The Probable Maximum Flood is the credible upper limit. Some councils map it, many do not. Evacuation planning, vulnerable land uses and essential infrastructure often hinge on the PMF rather than the DFE, so its absence from a dataset is a real gap for anything beyond a single dwelling.

Queensland and NSW frame the same hazard differently

The underlying hydraulics are the same physics, but the planning scaffolding around them is not.

In Queensland, flood mapping usually lives in the local government planning scheme as a flood hazard overlay, often supported by a flood study adopted by council, and increasingly cross-referenced against the state Flood Hazard Area layers. Coverage and vintage vary enormously between councils. A large regional council may have detailed 2D hydraulic modelling for its urban catchments and nothing but broad regional mapping for its rural fringe.

Critically for buyers, flood does not appear on the new Form 2 seller disclosure statement. The Property Law Act 2023 regime, mandatory since 1 August 2025, deliberately leaves natural hazards out of Part 3. The seller is not required to tell you the block floods. That exclusion is not an oversight, it reflects that flood is public mapping the buyer is expected to investigate. So the onus sits entirely with the purchaser and their advisers.

In New South Wales, the picture is shaped by the Flood Prone Land Package and the state's flood risk management framework. The section 10.7 planning certificate is the formal instrument here. Its clause 7.3 style flood entries tell you whether the land is affected by a flood related development control in the LEP, and whether council policies apply. But read the certificate carefully: a 10.7(2) certificate may note flood control applies without giving you levels, extents or categories. The detail lives in the council flood study and the DCP, which the certificate points toward rather than reproduces. A blank flood line on a 10.7(2) does not prove the land is flood free; it can simply mean council has not adopted a control for that parcel yet.

Where the data quietly lets you down

Every flood dataset carries assumptions, and the honest read is to know which ones are load-bearing.

Vintage. A flood study modelled a decade ago used the rainfall estimates and catchment conditions of its day. Australian Rainfall and Runoff guidance and design rainfall intensities have since been revised. Upstream development, new detention basins, culvert upgrades and channel works can all shift extents that the published map has not caught up with.

Model resolution. Regional or catchment-scale mapping is often derived on a coarse grid and interpolated. At the individual lot scale it can misplace the waterline by more than the width of a setback. It is indicative of the hazard, not a survey of your boundary.

Local drainage is usually excluded. Most riverine flood studies model the main watercourse, not the blocked pit at the low point of your street. Overland flow and stormwater surcharge cause a large share of real-world inundation and frequently sit outside the mapped riverine overlay entirely. This is exactly the kind of clue worth chasing in what listing photos hide about flood and ground before you ever reach the mapping.

Freeboard and datum confusion. Mixing a flood planning level that already includes freeboard with a modelled flood level, or comparing a level in AHD against a floor level someone measured off local ground, produces nonsense. Confirm the datum before you compare numbers.

Turning the mapping into a defensible position

For a professional making a call, the sequence is less about the colour on the screen and more about assembling the evidence behind it.

  1. Identify the governing event and whether the mapped line is a flood extent or a flood planning area with freeboard baked in.
  2. Find the source study, its adoption date and its ARR vintage. An undated overlay is a prompt to dig, not a conclusion.
  3. Establish the hydraulic category if the study offers one. Floodway changes everything.
  4. Check for local overland flow mapping separately from the riverine overlay.
  5. Reconcile flood levels against a surveyed floor or ground level in a consistent datum before advising anyone on freeboard or habitable floor height.

Common questions

Does a property outside the flood overlay mean it won't flood?

No. Overlays are usually tied to a nominated design event and to riverine modelling. Rarer events, overland stormwater flow and out-of-date studies can all put water on land that sits outside the mapped line. Absence from the overlay lowers the likelihood, it does not remove the risk.

Why isn't flood shown on the Queensland Form 2 disclosure statement?

Because the disclosure regime deliberately excludes natural hazards. The seller is not obliged to disclose flood exposure, so the buyer has to investigate it independently through council flood studies, the planning scheme overlay and site-specific advice.

What's the difference between the 1% AEP flood and the PMF?

The 1% AEP is the common design event, a one percent annual chance, and it usually drives building controls. The PMF is the credible worst case and governs evacuation and vulnerable uses. A block can be comfortably above the 1% AEP level yet still inundated in the PMF.
