1. About These Terms
These Terms and Conditions ("Terms") govern your use of the LayeredGeo website and services ("Service") operated by LayeredGeo Pty Ltd (ABN 23 695 076 745) ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
LayeredGeo provides a suite of property intelligence tools for sites in Queensland, New South Wales and Victoria, Australia, compiled from publicly available government spatial datasets. The Service includes:
- Geotechnical reports and planning overlay reports - automated site summaries delivered as PDF documents;
- GIS data exports - site spatial data delivered as downloadable files (e.g. DXF, Shapefile, GeoPackage, KMZ);
- Scout - a browser extension that surfaces property screening data on third-party listing pages;
- Free tools - browser-based utilities provided free of charge, including file converters (e.g. 12d to DXF, PDF markup to DXF, AGS to CSV) and calculators (e.g. the AS 2870 site classification calculator).
Not all features, datasets, or coverage are available for every property or location. The Service and its outputs are provided for informational purposes only. They do not constitute professional engineering, geotechnical, environmental, or planning advice and must not be relied upon as such. You should engage a suitably qualified professional for any design, construction, or regulatory purpose.
Outputs of the free tools (including converted files and calculator results) depend on the files and values you supply. You are responsible for verifying any converted or calculated output against the original source documents before relying on it for any design, setout, construction, or contractual purpose.
3. Eligibility
You must be at least 18 years old and have legal capacity to enter a contract to use the Service. By creating an account you represent that you meet these requirements.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@layeredgeo.com.au if you suspect unauthorised access.
5. Payments and Credits
Reports, data exports, and other paid features are purchased via credits or subscription plans as displayed on the Pricing page. All prices are in Australian dollars and include GST where applicable. Payments are processed securely by Stripe.
Credits are non-refundable once consumed (i.e. once a report has been generated). Unused credits on a pay-per-report pack do not expire. Subscription credits reset monthly and unused credits do not roll over.
We reserve the right to change pricing at any time. Changes will not affect credits already purchased. If we increase the price of a subscription you are already on, we will tell you by email at least 14 days before the increase takes effect, so you can cancel first if you do not want to continue.
6. Subscriptions, Renewal and Cancellation
Subscription plans, including Scout, renew automatically at the end of each billing period and are charged to your payment method until you cancel. Each renewal is for the same period and at the price then displayed on the Pricing page, subject to the notice above.
You can cancel at any time from your account page, or by emailing hello@layeredgeo.com.au. There is no cancellation fee and no minimum term.
Cancellation takes effect at the end of the billing period you have already paid for. You keep full access, and any credits included in that period stay usable, until that period ends. We do not charge you again after that. We do not pro-rate or refund part of a period you have already started, and any subscription credits still unused when the period ends are lost, consistent with the monthly reset described above.
7. Refunds
If a report or data export fails to generate due to a fault on our end, we will issue a credit refund to your account. Refund requests must be submitted within 30 days of purchase by contacting hello@layeredgeo.com.au. We do not offer cash refunds for change-of-mind purchases.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Resell, redistribute, or sublicense reports or access to the Service without our prior written consent;
- Attempt to reverse-engineer, scrape, or systematically harvest data from the Service;
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
9. Intellectual Property
LayeredGeo retains all intellectual property rights in the Service, including the software, design, and compilation methodology. Report output is derived from third-party government datasets; we do not claim ownership of the underlying source data.
You are granted a non-exclusive, non-transferable licence to use generated reports and data exports for your own internal business or personal purposes.
10. Data Accuracy
Reports and data exports are compiled from publicly available government spatial datasets that may contain errors, omissions, or outdated information. We make no warranty as to the accuracy, completeness, or fitness for purpose of any report or export. You accept full responsibility for any decisions made on the basis of an output from the Service.
11. Service Availability
We provide the Service on an "as is" and "as available" basis. We do not warrant that the Service will be available at any particular time, uninterrupted, error-free, or compatible with your device, browser, or software. We may suspend access without notice to carry out maintenance, repairs, or upgrades, or where required to do so by law. To the maximum extent permitted by law, we are not liable for any loss arising from the Service being unavailable or from any delay or error in generating a report or export.
12. Assumption of Risk
You acknowledge that decisions about land, property, construction, and development carry inherent risk. To the maximum extent permitted by law, you assume the entire risk arising from your use of the Service and its outputs. It is your responsibility to determine whether a report, data export, or other output is suitable for your intended purpose, and to obtain appropriate professional advice before acting on it.
13. Limitation of Liability
To the maximum extent permitted by law, LayeredGeo's total liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid for the specific report or data export that gave rise to the claim. Where the feature or output that gave rise to the claim was provided free of charge (including the free tools), our total liability is limited, at our election, to re-supplying the output or AUD $10.
We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, loss of data, or business interruption, however caused.
We are not liable for any loss or damage caused by viruses, malware, or other harmful code that may affect your hardware or software as a result of using the Service or downloading any output.
Nothing in these Terms excludes or limits any guarantee or right that cannot lawfully be excluded under the Australian Consumer Law. Where our liability for failing to comply with such a guarantee cannot be excluded but can be limited, our liability is limited (at our election) to re-supplying the relevant report or data export, or paying the cost of having it re-supplied.
14. Indemnity
You agree to indemnify and hold harmless LayeredGeo Pty Ltd, its directors, employees, and agents from and against any claim, liability, loss, cost, or expense (including reasonable legal costs) arising out of or in connection with: (a) your breach of these Terms; (b) your use of the Service or any report, data export, or other output; (c) your infringement of the intellectual property or other rights of any third party; or (d) your breach of any applicable law.
15. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms where that failure or delay is caused by circumstances beyond our reasonable control. Such circumstances include, without limitation: natural disasters, fire, flood, storm, or earthquake; acts of war, terrorism, riot, or civil unrest; cyber-attacks, malware, or third-party data loss; failure of internet, telecommunications, hosting, or power providers; changes in government law or regulation; and industrial disputes.
16. Suspension and Termination
We may suspend or terminate your account or your access to the Service immediately and without notice if you breach these Terms, if we reasonably suspect misuse of the Service or fraudulent payment activity, or where we are required to do so by law. Where we do this, any unused credits on your account are forfeited.
We may also stop offering the Service, or close your account for any other reason, by giving you at least 30 days' notice by email. In that case you may keep using any credits you have already paid for during the notice period, and if you are not able to use them we will refund the unused balance. This is the only circumstance in which we refund credits that have not been consumed.
You may close your account at any time by contacting us. We are not obliged to retain or back up your account data or generated outputs following suspension or termination, so download anything you want to keep before closing your account.
Any provisions of these Terms that by their nature should survive termination - including those relating to intellectual property, data accuracy, limitation of liability, indemnity, and governing law - will survive.
17. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
18. Changes to the Service and Terms
We may modify the Service or these Terms at any time. Material changes will be notified by email or by a prominent notice on the website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
19. Governing Law
These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising under these Terms.
20. General
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms on notice to you. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to the Service.
